How do Section 301 exclusions expire, and what should importers file before they do?

Section 301 exclusions are temporary by design, granted for named products under specific HTS lines and given expiry dates that arrive whether an importer is ready or not. This post explains how exclusions lapse, what an extension request involves, and how to cost a product line for the day after expiry.

Exclusions were built to end

When USTR granted product exclusions from the Section 301 lists, each came with a defined window. Some were extended, some repeatedly, and some lapsed quietly while importers were still pricing goods as if the exclusion were a permanent feature of the product. It never was. It was a stay, and stays expire.

The exclusion also travels with a description, not just a tariff number. Two products under the same ten digit line can sit on opposite sides of an exclusion if the written description covers one configuration and not the other. Importers who track exclusions by HTS code alone discover this at entry, which is the most expensive place to learn it.

The calendar work nobody assigns

Build the expiry register at SKU level: product, HTS line, the Chapter 99 exclusion note claimed, the expiry date, and the duty rate the morning after. Assign it an owner. In most mid sized importers that register does not exist, and the first notice of a lapse is a broker asking why this entry suddenly owes 25 percent more than the last one.

Goods on the water straddle the line awkwardly, because what counts is the date of entry, not the date of order or shipment. A container loaded under an exclusion can land after it and pay in full. Purchase contracts that ignore that gap hand the whole increase to whichever party the paperwork happens to catch.

Extensions are argued, not renewed

When USTR opens a comment process on expiring exclusions, extensions go to products whose case gets made with specifics: no available source outside China, the economic harm of the duty, efforts made to source elsewhere and what they found. Comments that say the tariff would raise our prices, without that evidence, compete against thousands of identical letters.

File even when the odds look poor, and file with the specifics above. The comment record also matters later: it is the public evidence that the importer treated the issue as live, which counts in internal planning and in customer conversations when prices have to move.

Price for the day after

Run the landed cost both ways for every excluded line, at the exclusion rate and at the full rate, and decide in advance which products absorb, which reprice, and which get dropped if the exclusion ends. That decision made in a calm week is a strategy. The same decision made against a customs bill is a scramble, and scrambles are where margin goes to die.

Frequently asked questions

How does an importer claim a Section 301 exclusion at entry?

By entering the product under its HTS classification together with the Chapter 99 note that carries the exclusion, such as the 9903 series notes USTR assigns. The broker needs to know the exclusion applies before filing; it is not applied automatically by the tariff number alone.

What happens to goods shipped before an exclusion expires but entered after?

Duty follows the entry date. Goods that enter after the exclusion lapses pay the full Section 301 rate even if they were ordered and shipped while the exclusion was live. That gap should be covered in purchase terms for long transit lanes.

Can an expired exclusion come back?

Exclusions have been reinstated and extended in past rounds, usually through a USTR comment and review process rather than automatically. Importers should treat return as possible but never plan pricing on it.

What makes a strong extension comment to USTR?

Product specific evidence: why the item cannot be sourced outside China in the needed specification and volume, what sourcing efforts were actually made, and the concrete economic harm the duty causes. Generic requests for relief carry little weight against documented cases.
